The Appellate Division of the Supreme Court has upheld a High Court order that stayed the Dhaka University Central Students' Union (DUCSU) election. As a result, there is no obstacle to the DUCSU election on September 9, said the lawyers.

A three-member bench of the Appellate Division, headed by Chief Justice Syed Refaat Ahmed, passed the order on Wednesday.

The Appellate Division passed the order after hearing a writ petition filed challenging the candidature of Oikya Chhatra Jote's GS candidate SM Farhad in the DUCSU election.

Barrister Jyotirmoy Barua stood for the writ petitioner while Advocate Shishir Monir stood for Dhaka University and Barrister Imran A Siddique for SM Farhad.

During the hearing, DU lawyer Advocate Mohammad Shishir Monir said that there is no legal basis for filing the writ challenging the candidacy of SM Farhad, the GS candidate of the panel nominated by the United Students' Alliance in the DUCSU election.

"Writ petitioner Fahmida Alam is not a GS candidate. He was not personally harmed. Therefore, this writ cannot continue. The writ petitioner filed the writ intentionally to foil the DUCSU election.

SM Farhad's lawyer Barrister Imran A Siddique said that the allegations brought against SM Farhad, the GS candidate of the panel nominated by the United Students' Alliance in the DUCSU election, are not true.

He also said that there was another student named SM Farhad in the Persian department who was a BCL office holder. Farhad is different.

After the hearing, the Appellate Division upheld the chamber judge court's order that stayed the High Court order. As a result, there is no obstacle to the DUCSU election on September 9.
