Commission proposes alternative proposal to convince BNP

The National Consensus Commission is going to make an alternative proposal after failing to convince the BNP to distribute seats in the upper house among political parties based on the proportion of votes received in the election (PR).

The commission, headed by the chief advisor, has already sent the agenda for Monday's dialogue to the political parties. The commission's alternative proposal says that the upper house will be formed with 76 people's representatives elected from 64 districts and 12 city corporations. However, leaders of several parties including Jamaat-e-Islami, NCP, and Islamic Andolan told that this proposal is unacceptable. There is no scope for discussion on this.

The commission proposal, which includes 30 political parties and alliances participating in the ongoing dialogue, has agreed to form 28 bicameral parliaments. According to the commission's previous proposal, the lower house of parliament will have 400 members. It will be elected under the existing 'First Past the Post' (APTP) system. The one who receives the highest number of votes among the political party nominees and independent candidates will win.

The percentage of votes a political party gets in this election will determine the number of seats it will get in the 100-seat upper house. 23 parties, including Jamaat, NCP, and Islamic Andolan, agree on this. BNP's allies in the simultaneous movement, the People's Rights Council, the People's Solidarity Andolan, JSD, and Nagorik Oikya, also agree on this.

BNP has promised to establish an upper house in the 31-point plan announced in July 2023. However, the party wants the distribution of seats in the upper house to be similar to the existing distribution of reserved seats for women in parliament. The party that wins the percentage of seats in the lower house of parliament will also win the same percentage of seats in the upper house. As a result, the percentage of seats of political parties in both houses of parliament will be the same. But the commission has proposed that a two-thirds majority in both houses of parliament will be required to amend the constitution. According to BNP, if the seats in the upper house are distributed in proportion to the votes or through the PR system, no party will get 67 percent or two-thirds of the votes alone. As a result, there will be no opportunity for the government party to amend the constitution with a single decision in the future.

BNP Standing Committee member Salahuddin Ahmed believes that the government should have sole power to amend the constitution.

Like the commission, Jamaat, NCP, Islamic Movement and other parties argue that in the past, the ruling party has amended the constitution at will. To prevent this system, they are demanding the introduction of the PR system in the upper house of parliament. Otherwise, there is no need for an upper house. In the past, the ruling parties have arbitrarily changed the constitution despite getting more than two-thirds of the seats despite getting 40 to 49 percent of the votes. This is why the political crisis of 2007 occurred. Sheikh Hasina amended the constitution unilaterally in 2011. She abolished the provisions of the caretaker government and held three controversial elections under the party government. As a result, there has been an uprising by students and the public.
